
The 21st Century Cures Act of 2016 mandated direct access to health data for American patients.
The Department of Health and Human Services (HHS) announced that it will step up the enforcement against information blocking between information network products made by different companies. The department is seeking voluntary commitments from 60 companies that provide these services to American healthcare networks, including Medicare and Medicaid providers.
“Unblocking the flow of health information is critical to unleashing health IT innovation and transforming our healthcare ecosystem,” said Deputy Health Secretary Jim O’Neill. “We will take appropriate action against any health care actors who are found to be blocking health data for patients, caregivers, providers, health innovators, and others.”
The agency stated it will impose a penalty of up to $1 million for each violation of the ban on information blocking. The department also said that egregious violations could result in the possible termination of HHS certification.
